January 20,2024 update – reopening notice timeframe

An update on a common owner question, how much notice will we give on our re-opening date? As posted some time ago, HGV has told us that the insurance company will not be able to commit to any minimum amount of advance notice. It may be as little as a few days. It’s not that they don’t want to provide advance notice, they are unable to do so. Rebuilding our resort is like a complex chess game. The minute we think we understand the path to opening, something changes, unraveling our path. The insurance coverage will not reimburse any maintenance fees from the first day the resort opens and beyond. So many owners feel that HGV should cover all of this. Please be reminded that we are a homeowners association owned by our owners. HGV owes us nothing, it is our owners that collectively own our resort. Our operating funds come from owner maintenance fees and all expenses are paid from these funds. Any reimbursement outside of a covered insurance claim to one owner for maintenance fees would be absorbed equally by all the other owners and any such payment is against Florida statutes. If an owner owned a home outright on Fort Myers Beach and was rebuilding it, they would be faced with the same issue, it could not be used until it was properly rebuilt with town sign-off to occupy. Our situation is no different. We realize that this explanation does nothing to solve the uncertainty our owners are facing, however, there is nothing that we can do to solve this issue affecting so many of you. Tim
